CLDP to Hold Workshop on Adjudication of Bankruptcy Cases and Development of Judicial Benchbooks for Kosovo Judges

The two-day bankruptcy workshop, for approximately 20 judges, was led by Chief Judge Nancy Alquist, U.S. Bankruptcy Court, District of Maryland. The program served to provide a comparison between the different international bankruptcy systems and their perceived advantages/disadvantages for debtors, creditors and employees.  Chief Judge Nancy Alquist and Judge Marvin Garbis also prepared several country-specific interactive case studies.  The Kosovar judges involved analyzed the case studies and presented solutions according to current Kosovo law.  Afterwards, the U.S. judges discussed the U.S. perspective and key best practices they would employ when resolving these hypothetical cases.  Fairness, transparency, predictability and consistency were highlighted as the main requirements for helping to stabilize Kosovo's investment climate.

The third day of the program brought together a small group of key commercial division judges and KJI staff to discuss the potential development of judicial benchbooks for Kosovo's judiciary.  Ms. Corrin Gee from the Federal Judicial Center (FJC) provided guidance on how benchbooks are developed, drafted, edited, published, and utilized in the US.  CLDP will continue to work closely with KJI to further evaluate their capacities in order to create a strategy for future assistance programming.
